First Philo Farnsworth, a young Idaho family man, made the world’s first working television system with
electronic scanning of both the pickup and display devices. Before he faced any challenges he actually first demonstrated to news media in 1928 by televising a motion picture film along with other examples at other places.
In 1930, after a visit to Farnsworth’s laboratory, Vladimir Zworykin copied his for RCA. Farnsworth spent several years battling RCA who had the funds to produce more products similar to Farnsworth’s invention.
The U.S. Patten Office rendered a decision in 1935 that the “electrical image” of Farnsworth’s image dissector was not in Zworykin’s inventions, and priority of that invention was awarded to Farnsworth.
Wiping Away The Competition
Our second story centers around Robert Kearns, he was hit in the eye with a champagne cork and almost caused him to lose sight in one eye. That became serendipitous because it helped to inspire him invent the intermittent windshield wiper mechanism for use in light rain or mist. He set up his patent in 1967.
He tried to offer it to the big auto makers, but they said no thank you. It didn’t take long before some auto makers proceeded to install intermittent wipers in their cars in 1969.
He started legal actions against Ford in 1978 and Chrysler in 1982. By 1995, after many court battles reaching to the Supreme Court he had received approximately $30 million in compensation for their non-deliberate patent infringement.
Both of these men were saved because they set up patents. No matter how big those corporations were they won the battle (even if it takes years) to protect their intellectual property.

Another ideal example of intellectual property is a company’s name. It can be just as valuable as any tangible product in establishing a brand.

In order to protect your name you need to trademark it with the United States Patent and Trademark Office. There is an application form that they have online called the Trademark Electronic Application System (TEAS), available at http://www.uspto.gov/teas/index.html. When choosing a name you have to create a unique name and come to your lawyer with around ten different names so he can tell you which ones work and which ones will not fly. He can also check through a trademark database to figure out what related names could be in the way. The USPTO has 24/7 help that you can contact for assistance, but they can’t advise you the way a trademark lawyer could on potential names.
You don’t have to be an American citizen when you turn in this form, but it is suggested if you are out of the country that you have a domestic representative to help. You will have to attach a visual image (.jpg) of your potential Mark and be willing to explain where it will be used and for what purpose.
After you have submitted the name, the Trademark Application will go to a Trademark Lawyer that represents the government and he will either approve or return your application. The process can take up to a couple months. So be patient and make sure that you put a fully educated effort into getting a trademark that will work instead of having to go back in a couple months and revise it for whatever reasons
Once you have done all of this you will be on the path toward government protection. You might not be able to avoid a lawsuit or a legal procedure down the road, but at least you can protect your intellectual property against corporate monsters more than what you would have been able do before.
